Frivolous Marines

Gearbox and SEGA have responded to the reports of a class action lawsuit, brought against them regarding 'false advertising' for early footage of Aliens: Colonial Marines. SEGA responded with a pretty standard press release "SEGA cannot comment on specifics of ongoing litigation, but we are confident that the lawsuit is without merit and we will defend it vigorously."
But Gearbox were far more acerbic in their dismissal, "attempting to wring a class action lawsuit out of a demonstration is beyond meritless. We continue to support the game, and will defend the rights of entertainers to share their works-in-progress without fear of frivolous litigation." they said, which was not exactly the wisest thing they could have done. As much as I agree this whole thing has been blown way out of proportion, acting like dicks about it won't win you any consideration.
It will be interesting, in a depressing, farcical way, to see how this charade plays out. But the whole thing smacks of shameless and shameful opportunistic profiteering on the part of Edelson LLC. I simply cannot believe this has anything to do with consumer rights. This class action, I am certain, is nothing more than a publicity stunt on behalf of Edelson. Their attitude on this is clear to me from their faux white Knight mentality after the success of their previous suit against EA and Sony, regarding Battlefield 1943 being removed from PlayStation 3 pre-orders for Battlefield 3.
